Motion by Terrie K. Terrio to approve the Applications Specialist revised job description with the qualification change from an Associate to a Bachelor’s degree required. Seconded by Gregory L. Miller.

Motion by Gregory L. Miller to approve the Network Telecommunications Specialist for posting, also with the Bachelor’s degree requirement under qualifications. Seconded by Scott R. Vele. Motion carried.

Motion by Terrie K. Terrio to approve the Model Permit for use of tribal land for business, eliminating on page 5, number 25; the Stockbridge-Munsee Tribal Court section, renumber 26 number 25 and to make responsible Land Management Department will be responsible for making sure permits are monitored and make sure that such permits do not lapse. Seconded by Gregory L. Miller. Motion carried.

Motion by Jolene Bowman to adopt resolution number 08-07, therefore be it resolved that the Stockbridge-Munsee Tribal Council hereby adopts Chapter 66, the Elder Protection Code. Seconded by Shannon Holsey. Motion carried.

Motion by Scott R. Vele to approve the request of Sherry White, Repatriation Officer, to have the President’s signature on the Memorandum of Agreement for the Recovery Significant Archeological Information with the New York State Preservation Office, the Town of Half Moon, the United States Army Corps of Engineers and the St. Regis Mohawk Tribe, that the undersigned concurs with the Memorandum of Agreement among the Army Corps of Engineers, the New York State Historical Preservation Office and the Town of Half Moon regarding the treatment of cultural resources in the vicinity of the Half Moon Town Park. Seconded by Terrie K. Terrio. (Bridget needs to review final document before signature). Motion carried.

Motion by Gregory L. Miller to approve the Tribal Child at the 250% and that we reduce the co-pay after the first child for each child thereafter. Seconded by Jolene Bowman.

Motion by Terrie K. Terrio to honor the request of Economic Support Director for the Elderly Bus Request to purchase one that does not require a CDL.

Motion by Jolene Bowman to go along with the Tribal Court’s recommendation to appoint a substitute judge, Kim Vele. Seconded by Shannon Holsey.

The Tribal Council did not complete the Executive Session discussions and will return after Open Agenda.

Questions on the LP Service, regarding elders checking their own gauges and no one answering the phone or being in the office.

Would like the Tribal Council to consider reopening the council meetings up to spouses of enrolled members and to employees with business with the council.

While in Executive Session discussion was held on a couple of Legal Issues, some gaming waivers and a personnel issue.

Motion by Scott R. Vele to approve gaming waivers for case number 07.7-W, which is resolution 08-08 for president’s signature, resolution 07-8-W, which is resolution number 09-08, gaming waiver 07.9-W, which is resolution number 10-08, gaming waiver 07.10-W, with a resolution number 11-08 and the gaming waiver 07.11-W with resolution 12-08, as recommended by the Gaming Commission and for the President’s signature.

Motion by Scott R. Vele to approve the addendum to the Walsh Bishop contract as presented by Howard Bichler and negotiated by Dennis Walsh via the Tribal Council.

Motion by Scott R. Vele to continue the appeal of the court case, which is the State of WI verses the Stockbridge-Munsee Community, President Robert Chicks as discussed in Executive Session with Attorney Howard Bichler. Seconded by Gregory L. Miller. Motion carried.
